SCOTUS Ties Judges Hands- Executive Orders Can Avert the Law; Trump Can Now Become an Imperial King (American Issues Take One - recorded on 7/2/2025). The hosts for this show were Tim Apicella and Jay Fidell. The guests were Benjamin Davis, Chuck Crumpton and David Larson.
The discussion was: When a federal district court judge makes a ruling or places an injunction, it's applied nationwide if the case was found to be in violation of the US Constitution. All that changed with the recent SCOTUS decision, Trump v CASA Inc. From this point forward if a presidential executive order is determined to be in violation of an article of the US Constitution, the party filing suit against the order is to receive the relief from the district judge's ruling, not other parties in the country adversely impacted by the same unlawful presidential executive order. By this SCOTUS decision, the current president and future presidents will have unbridled power until the unlawful executive orders are challenged in the US Supreme Court. This monumental shift in how the current judicial court system works will impact the balance of power between the three branches of government, and how they will interact. The decision is yet another victory for the executive branch as was last year's SCOTUS decision, Trump v United States, granting presidential immunity. The panel will discuss impacts of recent decision and impact upon federal district courts.
The takeaway was: Federal judges have been handcuffed and the president's ability to issue executive orders that are in full violation to the rule of law is now sealed with the SCOTUS court decision, Trump v CASA Inc.
